

OUR PRESIDENT’S MESSAGE
It is hard to believe that 2008 has gone by so quickly. Although attendance was down at our Harvest Party, those of us who did attend had a great time. The two $ 250 drawing winners held during our annual Harvest Party to be applied towards the 2009 AALNC’s educational tuition are Teresa Cox and Kristen Henderson [new member]. I hope that many of our members will be able to attend this year; it is definitely on my agenda.
Thank you Anne for all your hard work organizing and planning the party. Even though life circumstances did not allow you to enjoy the festivities with us, it was greatly appreciated and enjoyed by all.
I also want to thank everyone who volunteered and was elected to our 2009 Board; it looks like it will be another great year.
I hope to see you all on October 22, 2008, at our next dinner educational. Our last board meeting was cancelled due to not having a quorum for voting. We do have some important issues to discuss and vote on very soon.

Life Care Planning Conferences

Mariann Cosby attended two national life care planning conferences in September. Celebrating ten years as an organization, she attended the American Association of Nurse Life Care Planners conference in San Diego which was a hit with their theme: Catch the 10 year wave – Empowering Nurse Life Care Planners. Utilizing the nursing process and nursing diagnosis as the basis for the nursing recommendations in the LCP was reviewed and presented by the board. Current President, Shelene Giles, shared many useful tips on formulating a pediatric burn life care plan and updates on the Medicare Set Aside process. Fun was had by all in the evening with a creative scavenger hunt and dancing into the wee hours of the nights.
Following this 4 day conference, Mariann then traveled to Scottsdale, Arizona for the 2008 International Symposium on Life Care Planning. Watching the sunrise over the desert mountain’s during the daily 6 a.m. morning walks to the late Saturday night dinner and dancing with a live band, it was 5 days filled with various networking opportunities interspersed with the conference agenda. Topics included: home modifications, international classification of function, and tips regarding depositions and trial testimony. Karen Preston was also in attendance and presented a summary of the 2008 Life Care Planning Summit from earlier this year. Pre and post conference options provided additional education on polytrauma and projecting future medical costs. Reservations are already being taken for next year’s event which is to be in Chicago. See you then!

Harvest Festival Celebration
Our Harvest Festival was celebrated at a lovely location during a beautiful evening in late September. We all settled out on the restaurant patio with the river in view and the sun setting over the trees. We pushed our tables together and enjoyed sharing special wines brought by our members. As always, with this wonderful group, there was plenty of warm support and advice from the experienced LNC’s to the new and a sharing of ideas, encouragement and tips of the trade. But, above all, there was good food, great stories and much laughter during this wonderful celebration. -TRC

General Updates
· The AALNC Call for Nominations for the 2008-2009 year is now open. To be considered as a candidate for the board of directors or for the nominating committee, you must be an active AALNC member in good standing for a minimum of two years who currently practices legal nurse consulting. The following positions are available:
o Nominating Committee Member (Term of office: 2 years; Positions available: 2)
o Director-at-Large (Term of office: 2 years; Positions available: 1)
o Director-at-Large (Term of office: 3 years; Positions available: 2)
o Secretary/Treasurer from amongst those DAL’s who have served one year of their term on the board (Term of office: 1 year; Positions available; 1)
o President-elect (Term of office: 3 years – 1 year as president-elect, 1 year as president. Nominees for President-elect must have served on the AALNC Board of Directors within the past 3 years.)

· On Thursday, September 25th through Saturday, September 27th, AALNC exhibited at the Emergency Nurses Association (ENA) Scientific Assembly in Minneapolis, Minnesota.
· The AALNC Board Meeting took place mid-August in Chicago. The meeting was very successful and productive and we look forward to sharing our new ideas and initiatives for AALNC and its future.
· During the board meeting, one of the 2008 AALNC goals was to document our AALNC Board of Directors culture. A culture statement articulates the values and beliefs of the organization and identifies the expectations of board members and AALNC volunteers.
· LNC programs and their websites: Realizing that chapter presidents and volunteers often times get inquiries from potential LNC's about what educational programs are available, we wanted to share a resource that was prepared by AALNC Members Beth Zorn and Margie Pugatch. The chart gives an overview of available LNC programs and their websites and lists information about costs, continuing education, and certificate or certification options. The course chart is located in the files section of LNCExchange at http://health.groups.yahoo.com/group/LNCExchange/files, in a folder called “LNC Courses” (please note, only members of LNCExchange have access to the files and links section). We hope that chapter presidents will be able to utilize this summary when talking to potential LNC's. As this is a work in progress, this chart will be updated and we will make sure to keep the e-Community archive updated as well.
· The AALNC Awareness Committee is one of several committees at the national level. The purpose is to serve as a conduit to the AALNC membership on attorney outreach issues, and to explore ways to educate the end-user community on the value of LNC's. One of the main initiatives during this past year is: Resources for Grassroots Efforts. This initiative is to develop resources to assist chapters with grassroots efforts, including gaining membership status in local or state bar associations. Attending bar association events or exhibiting at legal conferences has long been considered an important venue for networking with potential attorney clients. To create additional networking opportunities, some LNC's have joined their bar associations as associate members. Not all bars allow non-attorney members, but of those that do, many have a membership category for paralegals. Other organizations have opted to create a separate category for LNC's within the bar, such as the LNC Division of the West Virginia Bar Association. There are many ways for chapters to become involved with their bar associations. While LNC membership is an important goal to pursue, it may not be possible in every state, depending on how the bar association is structured. There are other avenues LNC's can consider to increase their involvement in the bar association. Such opportunities include forming a speaker’s bureau and presenting at bar meetings, writing articles for the bar newsletter and coordinating the submission of articles through a chapter committee, and assisting with pro bono programs. · The Attorney Awareness Campaign is increasing attorneys’ use of the LNCLocator, a free service available to the public. Please maintain your member profile by logging in to www.aalnc.org and looking for the welcome box on the left of the page, with your membership options underneath. To change any member information, click on the “Edit” button at the top of the page, make your edits in the appropriate section, and hit “Submit” at the bottom of the page. The LNCLocator is connected to our membership database, so your information will automatically be updated at Headquarters and will be reflected immediately in the LNCLocator. · Are you having a hard time finding nurses in your state? Visit your state Licensing Board today and obtain a list of all nurses in your state for a minimal cost. This is just one more way to get more involvement and leaders and to help plan future educational programs!

This device was manufactured from May 20, 2004 through August 11, 2007 and distributed from May 20, 2004 through December 4, 2007. Two hundred forty-nine (249) devices are affected.
The product was recalled because the AED instructs the responder by voice prompts to press the shock button which is not visible because it is covered, thereby making the responder unable to provide shock therapy. The AED device should be removed from service, or the manufacturer-provided diagram should be consulted to remove and discard the shock button cover.

MEDICARE INCREASES NURSING HOME PAYMENT RATES
Medicare payment rates to nursing homes will increase by $780 million next year, the Centers for Medicare & Medicaid Services (CMS) announced. The boost in payments is the result of a 3.4 percent increase in the annual market basket calculation of the cost of goods and services included in a skilled nursing facility stay.
The proposed rule announcing the planned recalibration was published in the Federal Register on May 4, 2008.

Abbreviated Information from CDC and FDA on the Safety of Gardasil Vaccine
FDA approved Gardasil vaccine on June 8, 2006 for use in girls and women 9 through 26 years of age. This vaccine prevents infection with the types of HPV that cause most cases of cervical cancer and genital warts. As of June 30, 2008, there have been 9,749 VAERS (Vaccine Adverse Event Reporting System) reports of adverse events following Gardasil vaccination. Of these, 94% were classified as reports of non-serious events, and 6% as serious events.
As of June 30, 2008, 20 deaths had been reported to VAERS. There was not a common pattern to the deaths that would suggest they were caused by the vaccine. In cases where autopsy, death certificate and medical records were available, the cause of death was explained by factors other than the vaccine.
Based on ongoing assessments of vaccine safety information, FDA and CDC continue to find that Gardasil is a safe and effective vaccine. FDA and CDC continue to monitor the safety of this vaccine, with the public's health and safety our top priority.

Assembly Bill 3 (Bass) became effective on January 1, 2008:
Changes to California Law regarding supervision of physician assistants (PA):
Assembly Bill 3 changed items pertaining to the practice of PA’s in California.
Here are a two of the significant changes:
à Ratio of PA’s to supervision physicians: a supervising physician may now supervise no more than four PA’s at any one time rather than the two previously allowed.
à Chart countersignature: previously protocols stated the supervising physician was to review and sign a minimum of 10 percent of the patient charts of the PA within 30 days. The new requirement was decreased to only 5 percent.

Medicare & Medicaid Services
Effective October 1, 2008
Section 5001(c) of the Deficit Reduction Act (DRA) of 2005 required the Secretary of the Department of Health and Human Services
to select at least two conditions that are: (1) high cost, high volume, or both; (2) identified through ICD-9-CM coding as a complicating condition (CC) or major complicating condition (MCC) that, when present as a secondary diagnosis at discharge, results in payment at a higher MS-DRG; and (3) reasonably preventable through application of evidence-based guidelines. The law further required hospitals to begin reporting on claims for discharges, beginning October 1, 2007, whether the selected conditions were present on admission (POA).
CMS has selected a total of eight conditions for the HAC provision. Beginning October 1, 2008, Medicare will no longer pay at a higher weighted MS-DRG for these conditions. Removing an object left in during surger

- The Fall 2008 LNCC exam has been scheduled for Saturday, October 25, 2008. The exam will be offered in approximately 30 cities nationwide. Applications for the fall LNCC exam are now available online at www.lnccertified.org and the application deadline is September 19, 2008.
- Additional information about LNCC certification can be found at www.lnccertified.org. The LNCC Practice Test is available for purchase via the AALNC online bookstore or by calling AALNC Headquarters at 877/402-2562.
- Each LNCC® will now receive a wallet card verifying their certification once they have passed the exam. All currently certified LNCCs should have received these cards in the mail. Those who passed the Spring exams will receive their wallet card and other certification materials within 2 weeks.
